Takedown Procedure (DMCA Notice)

If you believe that your copyrighted work has been infringed on our website, please notify our Copyright Agent with a written communication including all of the following:

  1. Physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list of such works.
  3. Identification of the infringing material and information sufficient to locate it (URL or specific page reference).
  4. Contact information of the complaining party: name, address, telephone number, and email address.
  5. A statement that the complaining party has a “good faith belief” that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.

Counter-Notification

If you believe that material you posted was removed by mistake or misidentification, you may file a counter-notification including:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location where it previously appeared.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, telephone number, and a statement consenting to the jurisdiction of the Federal District Court for your district, and that you will accept service of process from the original complaining party.

Repeat Infringer Policy

Global CMK maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. A repeat infringer is a user who has been notified of infringing activity more than twice or has had infringing material removed from our website more than twice.

Canadian Copyright Act — Notice-and-Notice Regime

In addition to DMCA compliance, Global CMK complies with Canada’s Copyright Act Notice-and-Notice provisions. Copyright owners may send a notice of claimed infringement, which we will forward to the alleged infringer while retaining records as required by law. We do not determine the merits of copyright claims — we facilitate the notice process as required by law.

Misrepresentations

Under 17 U.S.C. 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorney’s fees.
